- German court rules VW, Audi must pay vehicle owners in emissions cheating class action: Germany’s Federal Court of Justice ruled that Volkswagen and Audi must pay drivers of vehicles that were equipped with emissions defeat devices by the automakers between 5-15% of the purchase price of those vehicles.
- Supreme Court rules companies can be sued in any state where they are registered: The U.S. Supreme Court’s ruling in Mallory v. Norfolk Southern Railway found that companies may face lawsuits in states where they are registered to do business, even in cases where the lawsuit otherwise has no direct connection to the state.
- SCOTUS ruling in Mallory raises concerns among business community: Following the Supreme Court’s ruling in Mallory v. Norfolk Southern Railway, members of the business community have expressed concerns that they may be forced to defend lawsuits in the future that are filed in states outside the location of where they are headquartered.
- California’s Lemon Law: the Song-Beverly Consumer Warranty Act: A post by Heygood Orr & Pearson partner Charles Miller examines the provisions of “California’s lemon law”, the Song-Beverly Consumer Warranty Act and the Tanner Consumer Protection Act.
- Infant deaths linked to recalled Boppy cushioned loungers following CPSC vote against ban: Despite at least 21 deaths that have been linked to Boppy Newborn Loungers, the Consumer Product Safety Commission voted in September 2021 against new regulations that would have forced manufacturers to redesign or stop selling these products.
